1. Acceptance of Terms

By accessing and using the Spark Brain Training platform (“Service”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

Spark provides a family of self-assessment quizzes and personalised reports (each, a “Report”), including a cognitive assessment (the Spark Cognitive Index, “SCI”), a childhood-trauma self-screen, and an archetype self-screen. Each Report summarises patterns based on your quiz answers and may include score bands, severity / risk labels (e.g. “Moderate”, “High”, “Very High”), and personalised follow-up suggestions. All Reports are for informational, educational, and entertainment purposes only and are not clinical, medical, psychological, or psychiatric diagnostic tools.

3. Account Registration

When you complete the quiz and purchase a subscription, an account is automatically created using the email address you provide. You are responsible for maintaining the confidentiality of your password and for all activities under your account.

4. Subscriptions & Payments

Spark offers subscription plans (4-week, 12-week, and annual). All payments are processed securely through Stripe. By subscribing, you authorise recurring charges at the applicable rate until you cancel. Prices are displayed at the time of purchase and may change with notice.

5. Cancellation & Refunds

You may cancel your subscription at any time from your Dashboard. Upon cancellation, your subscription remains active until the end of the current billing period. No partial refunds are provided for unused portions of a billing period. Your cognitive report remains accessible after cancellation.

6. Money-Back Guarantee

Please read carefully this Money-Back Guarantee Policy that regulates conditions and procedures of getting back money for purchasing the Spark subscription (the “Subscription”) on our website (the “Website”).

Refund under this policy applies provided that you made a purchase of your first Subscription for a month or longer period directly on the Website and met ALL of the following conditions:

  1. You contact us at [email protected] within thirty (30) days after your initial purchase;
  2. You provide us with the email address of your account with the Subscription eligible for the voluntary refund under this Policy;
  3. You have followed the personalised brain training plan at least during 20 consecutive days within the first 30 days after the purchase (the “Streak”); and
  4. You are able to demonstrate that you have the Streak pursuant to the requirements stated below in “How to demonstrate that you have the Streak”.

You are NOT ELIGIBLE to receive the voluntary refund under this Policy if you purchased the Subscription via the Google Play or the App Store. Subscriptions purchased via the Google Play or the App Store are subject to such app store’s refund policies.

You are NOT ELIGIBLE to receive the voluntary refund under this Policy if you subscribed for a period less than one (1) month. The “Money-back guarantee” option must be presented to you during checkout.

You are NOT ELIGIBLE to receive the voluntary refund under this Policy for renewed Subscription(s).

We will review your application and notify you by email whether your application is approved. Please be advised that we may investigate your use of the Spark app to ensure compliance with this Policy. By applying for the voluntary refund under this Policy, you expressly consent to such investigation. If such investigation reveals a possible violation of this Policy, we will not grant you the voluntary refund.

How to demonstrate that you have the Streak

You can demonstrate that you have the Streak if you provide screenshots from your profile page on the Spark app showing that you completed three training sessions every day during at least twenty (20) consecutive days.

Other Refund Rules

Generally, if you do not meet the conditions set out above, the fees you have paid are non-refundable and/or non-exchangeable, unless otherwise stated herein or is required by applicable law.

7. Intellectual Property

All content, design, scoring models, and reports are the intellectual property of Spark. You may not reproduce, distribute, or commercially exploit any materials from the Service without written permission.

8. Disclaimer

The Spark Cognitive Index (SCI) is not a clinically administered IQ test (e.g., WAIS-IV, Stanford-Binet 5). The childhood-trauma self-assessment is not a clinical, medical, or psychological diagnosis (e.g., DSM-5, ICD-11, ACE assessment) and any “risk level” or severity label it surfaces (including “Moderate”, “High”, or “Very High”) is a self-reported screening signal only. The archetype self-screen is a personality-pattern reflection and not a clinical or psychometric instrument.

Results from any Spark assessment should not be used for clinical, medical, mental-health, educational, employment, immigration, or legal decisions. If you have concerns about your cognitive function, mental health, or wellbeing, please consult a licensed professional. Spark makes no guarantees regarding the accuracy of scores, severity labels, or the effectiveness of any brain training, healing plan, or other recommendations.

9. Limitation of Liability

Spark shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding any claim.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance.
