1. Who we are
These Terms & Conditions (“Terms”) are between you and Arcarius Consulting Ltd, trading as Spark Brain Training (“Spark”, “we”, “us”, or “our”). Arcarius Consulting Ltd is the legal business that operates the Spark Brain Training platform and website at sparkbrainapp.com.
Contact: [email protected]
2. Acceptance of Terms
By accessing and using the Spark Brain Training platform (“Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
3. Description of Service
Spark provides a family of self-assessment quizzes and personalised reports (each, a “Report”), including a cognitive assessment (the Spark Cognitive Index, “SCI”), a childhood-trauma self-screen, and an archetype self-screen. Each Report summarises patterns based on your quiz answers and may include score bands, severity / risk labels (e.g. “Moderate”, “High”, “Very High”), and personalised follow-up suggestions. All Reports are for informational, educational, and entertainment purposes only and are not clinical, medical, psychological, or psychiatric diagnostic tools.
4. Account Registration
When you complete the quiz and purchase a subscription, an account is automatically created using the email address you provide. You are responsible for maintaining the confidentiality of your password and for all activities under your account.
5. Subscriptions & Payments
Spark is offered as a subscription that begins with an introductory / trial period and then automatically renews as a recurring membership (typically monthly). By subscribing, you authorise recurring charges at the applicable rate until you cancel. The length of your introductory period, your renewal date, and the applicable price are displayed at the time of purchase and confirmed in your welcome or receipt email.
Website payments may be processed by Stripe (where Spark / Arcarius Consulting Ltd charges you directly) or by Paddle as merchant of record / authorised reseller. When Paddle processes your purchase, your contract for payment is with Paddle under Paddle’s Buyer Terms, and your use of the Product remains subject to these Terms as the Supplier Agreement.
6. Cancellation
You may cancel your subscription at any time from your Dashboard (or, for Paddle purchases, via the manage-subscription link in your Paddle email). Upon cancellation, your subscription remains active until the end of the current billing period. You will not be charged again after that. Your results report remains accessible after cancellation. See our Subscription Policy for step-by-step cancel instructions.
7. Refunds
You may request a full refund within 14 calendar days of your Transaction date. Full details — including how refunds work for Paddle Merchant of Record purchases versus direct (e.g. Stripe) purchases — are in our Refund Policy.
Mandatory consumer rights (including any statutory withdrawal rights that apply in your country) are not limited by these Terms. Where local law or Paddle’s Refund Policy gives you a higher level of protection, that higher standard applies.
8. Intellectual Property
All content, design, scoring models, and reports are the intellectual property of Arcarius Consulting Ltd (trading as Spark Brain Training). You may not reproduce, distribute, or commercially exploit any materials from the Service without written permission.
9. Disclaimer
The Spark Cognitive Index (SCI) is not a clinically administered IQ test (e.g., WAIS-IV, Stanford-Binet 5). The childhood-trauma self-assessment is not a clinical, medical, or psychological diagnosis (e.g., DSM-5, ICD-11, ACE assessment) and any “risk level” or severity label it surfaces (including “Moderate”, “High”, or “Very High”) is a self-reported screening signal only. The archetype self-screen is a personality-pattern reflection and not a clinical or psychometric instrument.
Results from any Spark assessment should not be used for clinical, medical, mental-health, educational, employment, immigration, or legal decisions. If you have concerns about your cognitive function, mental health, or wellbeing, please consult a licensed professional. Spark makes no guarantees regarding the accuracy of scores, severity labels, or the effectiveness of any brain training, healing plan, or other recommendations.
10. Limitation of Liability
To the fullest extent permitted by law, Arcarius Consulting Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding any claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. The version in effect at the time of your Transaction governs that Transaction.
